Pennsylvania is a no fault insurance state. Regardless of whose fault the accident was, your insurance company will pay for certain benefits. Depending on the type of insurance you have, limited or full tort car insurance, you may be limited as to the extent of financial recovery you are entitled to. Drivers with full tort threshold insurance can sue for damages as well as economic and non economic losses. While some drivers elect for cheaper limited tort insurance this may be costly if you are in a serious car accident and don’t have full tort insurance. You should also keep in mind that neither your insurance company, nor the insurance company for the person you are involved in an accident with, has your best interest in mind; usually they are far more concerned with their bottom line and profitability and will pay as little as they can get away with. Uninsured Motorist (UM) Coverage

Underinsured Motorist (UM) coverage protects you, the driver, if you are injured in a car accident and the driver who caused the accident does not have car liability insurance. This may likely involve a fight with your own insurance company and Davant & Associates has the experience to go after all you are entitled to under a UM claim. Under Insured Motorist (UIM) coverage protects you, the driver, if you are injured in a car accident and the other driver does not have enough insurance to properly compensate you for your injuries and damages. Pennsylvania law requires a driver to carry only $15,000.00 worth of liability insurance. If such a driver causes an accident, where you or a loved one are injured, your Under Insured Motorist (UIM) coverage would offer protection if your pain and suffering would have a value greater than $15,000.00.
