Fraudulent Alteration of Medical Records

We always advise Clients with a potential medical malpractice case to try to obtain their medical records before providing them to our office for review. All too often, when we order the very same medical records, there are significant discrepancies and outright fraudulent alterations of a patient’s chart in attempts to avoid civil liability.

The fraudulent alteration of a patient’s medical record is not only a crime in most states, it also is actionable in a lawsuit.  Even with the advent of electronic medical records, it still may be possible to alter a patient’s medical records in efforts to avoid such liability. The advantage to the electronic alteration is that it will usually leave a record of who made changes. The law requires that changes made to a patient’s medical records require identification of exactly who made changes, when they were changes were made and why such changes were made. Absent such notation is per se a violation of the medical record keeping standard of care for health care providers.

At Davant & Associates we always look for the tell tale signs of fraudulent alterations that may be detected by inconsistent records, forensic examination, electronic date stamping and through third party electronic records portals. When discovered, a fraudulent alteration of a medical record or chart creates serious problems for health care provider defendants in a lawsuit.

The experienced lawyers at Davant & Associates will seek as much financial relief as possible for injured/damaged patients, and families of victims of fraudulent alteration of medical records.  We will have your case reviewed as quickly as possible, and let you know whether we believe you have a case we are willing to pursue, usually within days of obtaining relevant medical records.  In the event that we agree to take your case, we will retain experts to issue written opinions before we initiate a lawsuit, and to testify if necessary.  Please contact Davant & Associates for a no obligation free case evaluation.
